The USA Is No Longer Led By The Law-Abiding

Click this link to learn Robert Reich's views on Trump's total disregard for the law. Many are upset that, no matter how many federal judges attempt to stop him, he will disobey their orders. Obviously, Republicans in the Senate and House are not giving him any resistance. While I am very critical of this spinelessness, I can understand the fear that they all must have to be primaried and/or become victims of violence from "Trump's army" who are pardoned and show no sign of remorse for their January 6th actions.

Given the above, is there any hope that the US's democratic, representative, and secular government will survive? Some note that the legal challenges to Trump's orders also apply to those executing the acts. Thus, they also would be committing felonies. Would that be enough information to stop the unconstitutional/illegal actions at the levels below the POTUS?

Understand The US Department Of Education

The Department of Education collects statistics about schools to monitor student performance and promote practices based in evidence. It provides about 10% of funding for K–12 schools through federal grants of about $19.1 billion to high-poverty schools and of $15.5 billion to help cover the cost of educating students with disabilities.

"It also oversees the $1.6 trillion federal student loan program, including setting the rules under which colleges and universities can participate. But what really upsets the radical right is that the Department of Education is in charge of prohibiting discrimination on the basis of race and sex in schools that get federal funding, a policy Congress set in 1975 with an act now known as the Individuals with Disabilities Education Act (IDEA). This was before Congress created the department."

"In a scathing dissent from the bench on Friday, Justice Elena Kagan excoriated her conservative colleagues for inserting themselves into the realm of current and future regulation and warned of an impending massive shock to the administrative system.

'A longstanding precedent at the crux of administrative governance thus falls victim to a bald assertion of judicial authority,' Kagan said of the court’s ruling. 'The majority disdains restraint, and grasps for power.'

"In a 6-3 ruling, the justices on Friday ended the 40-year practice that informed federal judges’ decision-making when federal agencies and their actions were challenged. The high court's 1984 ruling in Chevron v. Natural Resources Defense Council had limited judicial decision-making in favor of agency expertise.

"A range of experts jumped on Kagan’s premonition, joining her in warning that Friday's decision will have far-reaching effects. From the halls of Congress to federal courtrooms, they say the decision opens the window for an increase in litigation against federal rules, as well as a potential chill on new ones.

“The federal government and environmental groups are going to be up to our ears in litigation just trying to preserve the status quo,” Sam Sankar, the senior vice president of programs at Earthjustice, said in a press briefing following the ruling."

As bad as the recent "Presidential Immunity" decision of the US Supreme Court was, this may have more harm.

Government And Mandates

The SCOTUS is about to paralyze any Federal government action during any crisis that affects its constitutional mandate to "promote the general Welfare." The Founding Fathers thought that this mandate was so important that they included it in the first sentence of the US Constitution.
